Introduction

'Need To Find A' is an Internet service owned and operated by Digitalica Limited, a company registered in England (registration no. 6311539). The terms “we” or “us” refer to Digitalica Limited. The terms “this service” or “the service” refer to the 'Need To Find A' service. The term "NTFA" is an abbreviation of 'Need To Find A'.

The terms “You" or "your" refer to a registered user of the NTFA service. You should be at least 16 years of age to use this service. If you allow anyone under the age of 16 to access this service, you take full responsibility for any action they take during use of the service. Your registration for and use of this service indicates your acceptance of these terms and conditions and our Privacy Policy. If you do not wish to be legally bound by these terms and conditions you must not use the service.

We reserve the right to change these terms and conditions at our discretion by advising of such amendments on the NTFA homepage and posting the amended terms and conditions on the NTFA website.

Your continued use of the service after changes are posted indicates your acceptance of those changes. If you do not wish to be legally bound by any future amended terms and conditions then you must discontinue use of the service.

The service provides a website that may be accessed by members and non-members to search for local businesses providing a range of services to the domestic market. Registered members may post reviews of businesses they have used to help other users in selecting businesses for their own use.

Non-Member Access

Non-members can access the NTFA website for the purposes of searching for businesses and reading associated reviews, but are not permitted to create their own reviews of businesses.

Membership

Users can register as one of 3 types of member:

  • Member
  • Business
  • Business Plus

Standard Membership

Standard members (known simply as "members") are users that intend to access the service solely for searching for/reviewing local businesses. They have registered with NTFA but have not paid a subscription fee. As a member, you are entitled to use the following facilities:

  • Access to all business search facilities along with details of the businesses found.
  • Post a review concerning their experience of any business used with a view to advising other customers of the suitability of that business in providing a service.
  • Receive newsletters (you may opt in/out of this during registration or by accessing your “Homepage” once you have joined)

Membership is on a continuous basis. Your membership will continue until you choose to cancel it.

Business Membership

Business members are users that primarily intend to use the service to advertise their services to the local domestic market (they are also entitled to use the service as a standard member would). They have registered with NTFA but have not paid a subscription fee. As a Business member, you are entitled to use the following facilities:

  • The ability to register and update your business details, to provide limited information to potential customers.
  • All facilities provided for standard members.

Business membership is on a continuous basis. Your membership will continue until you choose to cancel your membership.

Business Plus Membership

Business Plus members are entitled to use the service as a Business member would but are able to provide more detailed information for potential customers. They have registered with NTFA and have paid a subscription fee. As a Business Plus member, you are entitled to use the following facilities:

  • A priority position within any search results returned to other users.
  • The ability to modify the presentation of your details within any search results returned to other users.
  • The ability to create and edit your own web pages within the NTFA website or link to your own existing website.
  • All facilities provided for Business members.

When you first register (and pay your initial subscription), you have the right to cancel your Business Plus membership during the first 7 days of membership. This is in accordance with the Consumer Protection (Distance Selling) Regulations 2000.

Business Plus subscriptions may be paid on a monthly or yearly basis.

Monthly Business Plus subscription is on a continuous basis. Your subscription will be renewed automatically on a monthly basis until you choose to cancel your membership.

Annual Business Plus subscription is on a continuous basis. Your subscription will be renewed automatically every 12 months. You will be reminded 2 weeks before your subscription is due to expire and asked if you wish to cancel your membership. The reminder will be in the form of an e-mail and a message displayed within your member homepage.

If you register as a Business Plus member, you are agreeing to pay for this service for at least the minimum subscription period (6 months) regardless of payment period.

Member Responsibilities

You are responsible for the proper management and confidentiality of the material you hold on the NTFA service. As such, you are responsible for the control of access to your personal account. This includes confidentiality of your own password.

If any photograph intended for use in your Business Plus web-pages contains images of individuals, you must obtain consent from those individuals consent before uploading it to NTFA.

We reserve the right to remove any images of an individual if requested by the individual concerned.

Members agree not to defame, abuse, harass, threaten or breach the confidence of other members.

Members agree not to upload or insert any defamatory, abusive, offensive, obscene or unlawful material or information either in text or image form.

Members agree not to impersonate any other individual.

Members agree to provide reviews that are honest, fair and accurate.

Content Provided By Members

Except where otherwise expressed, all opinions, advice, statements, offers or other information made available by members through the NTFA website are those of members and not of us and should not be relied upon.

We are not responsible for and neither adopt nor endorse the opinions, advice, statements, offers or other information submitted to the NTFA website by members.

We do not guarantee the accuracy, completeness or usefulness of any information submitted to the NTFA website by members.

We are not responsible for any content submitted by members that is illegal, offensive or otherwise actionable.

Under no circumstances will we be responsible for any loss or damage resulting from anyone's reliance on information or other content posted by members on the NTFA website.

Service Provision

Provision of the service is intended to be as near as possible 24 hours a day, 365 days a year. There may be occasions when the service is temporarily unavailable for maintenance purposes, but these will be kept to a minimum.

We take no responsibility, nor will we be held liable for any aspect of the service being made temporarily unavailable due to technical issues beyond our control.

Disputes

In the event of the content of a review being disputed, we will mediate with the business and member concerned to try to resolve the issue. We reserve the right to determine the validity of any disputed review.

Membership Cancellation

As a standard member or Business member, you may cancel your NTFA membership at any time by notifying us via our "Contact" webpage.

As a Business Plus member, you may cancel your NTFA membership at any time, provided you have subscribed for the minimum subscription period (6 months).

If you wish to terminate your Business Plus membership, you must notify us at least 7 days before the subscription renewal date by sending a message via our "Contact" webpage.

If you cancel your Business Plus membership more than 7 days after your initial registration, your subscription fee will not be refunded for any unused portion of the minimum subscription period.

Your access to your NTFA account will be stopped as soon as your membership cancellation has been recorded and any data loaded to the NTFA website in the form of reviews or (in the case of Business Plus members) web pages and images will be destroyed.

Membership Termination

We reserve the right to suspend or terminate any member's access to the service if they are deemed to be in breach of any of these terms and conditions.

Complaints

Complaints should be communicated to us through our “Contact” webpage on the NTFA website. We will reply to all complaints within 5 working days.

In the event of a member or visitor notifying us of a potential breach of these terms and conditions, we undertake to investigate the claim promptly and take appropriate action on conclusion of the investigation.
